Types of Benefits You May Be Entitled to Receive

As provided by the Illinois Workers' Compensation Act, employees injured on the job are entitled to several benefits. First, workers are entitled to receive temporary total disability (TTD) benefits during their initial period off of work. This benefit is generally two-thirds of the employee's average weekly earnings, and is designed to provide them with a paycheck during the pendency of their claim.

Second, the injured employee is entitled to a medical benefit by which the costs of all necessary medical treatment are paid. Finally, once the employee has reached maximum medical improvement and is no longer totally disabled, he or she is entitled to a lump-sum settlement to compensate for any permanent disability, as either permanent partial disability (PPD) or permanent total disability (PTD).

The value of the disability claim is governed by the degree of disability that the worker continues to suffer even after having made maximum medical improvement. If the worker dies as a result of his or her work-related injuries, surviving family members may seek death benefits. This can help the family cover out-of-pocket expenses related to the accident, including funeral costs and medical bills.
