Understanding Forklift Accidents

Forklift accidents at construction sites account for nearly 35,000 injuries and about 85 deaths a year in the United States. Forklift trucks can weigh up to 9,000 pounds and travel up to 18 miles per hour. Having proper training can increase the safety of construction workers, and employers are responsible to follow the Occupational Safety and Health Administration (OSHA) regulations for forklift operation.

Under the code set forth by OSHA, employers of construction workers must:

  • Document and certify that each employee has completed forklift training
  • Enforce safety guidelines among workers
  • Regularly inspect forklift trucks to check for damage
  • Make any repairs necessary to keep forklift trucks running smoothly

Employers must also provide training and evaluation every 3 years for employees who have been involved in near-miss accidents, or who have operated forklift trucks unsafely. In addition, OSHA imposes standards for operators of forklift trucks to follow. It is the responsibility of operators to inspect the trucks for damage, drive within safe speeds, honk while driving in blind spots, and never lift other employees or engage in horseplay with the trucks. Furthermore, operators must only use factory-approved attachments on forklift trucks, as well as report damage to supervisors and take broken trucks out of service until repairs can be made.

Types of Forklift Injuries

Injuries from forklift truck accidents can be severe. They include fractures, spinal cord injuries, puncture wounds, crushed bones, traumatic brain injuries, internal hemorrhaging, and other severe conditions. If you are injured by a forklift truck, it is important to tell your employer right away and file a workers’ compensation claim. Our firm can investigate your incident, gather evidence, and represent your case in court.

There are 3 common types of forklift incidents that occur at construction sites. These include:

  1. Falling off a forklift
  2. Being crushed by a forklift
  3. Being struck by falling objects from an unbalanced load

If safety procedures are followed, OSHA estimates that nearly 70% of forklift accidents can be avoided. Employers must provide the proper training, supervision, and safety equipment to employees. If your injury was caused by employer negligence or someone else’s reckless actions, we can work hard to uphold your rights to compensation. Depending on your situation, you may be able to pursue a financial settlement for medical bills, disability, lost wages and future earning potential, pain and suffering, and other economic and non-economic damages.
