Aggressive Driving Accidents

Protect Your Rights with a Chicago Car Accident Attorney

Aggressive driving refers to a number of driving behaviors that involve a motor vehicle being operated in an unsafe and even hostile manner. When a motorist drives aggressively, they willfully disregard the safety of others and substantially increase the risks of causing a preventable traffic collision. Because aggressive driving is a clear display of negligence and carelessness, it constitutes a breach of a driver’s legal duty to take reasonable precautions when behind the wheel. As such, victims injured in car accidents caused by aggressive drivers have every right to pursue financial compensation for the damages they incurred.

Morici, Longo & Associates has been dedicated to protecting the rights of seriously injured victims throughout Chicago and the state of Illinois since 1998. Over the course of our nearly 20 years in practice, we have successfully handled many personal injury and wrongful death cases involving car accidents, including those caused by motorists who were driving aggressively. We know the devastation aggressive driving can cause, and we know how to hold negligent motorists accountable for our clients’ damages.

What is Aggressive Driving?

Aggressive driving encompasses many different acts of unsafe and even reckless driving behaviors, including:

  • Speeding
  • Following too close / tailgating
  • Disobeying traffic signs and signals
  • Unsafe and unlawful passing
  • Cutting off a vehicle / slamming on brakes
  • Hostile gestures or yelling
  • Repeatedly honking or flashing headlights

While some forms of aggressive driving may constitute traffic violations for which drivers can be cited, others in and of themselves, such as honking or yelling, do not. However, the National Highway Traffic Safety Administration (NHTSA) has worked with law enforcement and the judicial system to define aggressive driving as a combination of moving traffic violations and actions that endanger others and / or property.

What this means is that motorists who commit multiple traffic violations are engaging in aggressive driving, with or without hostility to other drivers as typified by “road rage.” In some cases, aggressive driving can certainly escalate into road rage and reckless driving that goes beyond a willful disregard for the safety of others, and drivers can face potential criminal repercussions when it does. Even if criminal allegations are made, these proceedings will not provide compensation to the injured victims. In order to seek a recovery of damages, victims will need to pursue personal injury claims in the civil justice system. Our legal team at Morici, Longo & Associates focuses on helping victims do exactly that.
