In Illinois, injured workers are entitled to workers compensation benefits by statute. Illinois' law dating to the early 1900s has provided the basis for workers comp claims for thousands of our clients.

As provided by the Illinois Workers Compensation Act, employees injured on the job are entitled to several benefits. First, workers are entitled to receive temporary total disability benefits during their initial period off of work following an injury. This particular workers comp benefit is generally two-thirds of the employee's average weekly earnings and is designed to provide the employee with a paycheck during the pendency of his or her workers compensation claim. Second, the injured employee is entitled to a medical benefit by which the costs of all necessary medical treatment are paid. Finally, once the employee has reached maximum medical improvement, and is no longer totally disabled, he or she is entitled to a lump sum settlement to compensate for any permanent disability. The value of the workers compensation disability claim is governed by the degree of disability as measured on an industrial basis that the worker continues to suffer even after having made maximum medical improvement.
